The following Opinion is written in reference to the official letter addressed to Acting judge of the Court of Summary Jurisdiction on the 17th instant.
The Ordinance establishing a Court of Summary Jurisdiction contains a provision enabling the Chief Justice, in time of pressure of business in the Supreme Court (as appears from the Preamble), to call upon the Judge of the Summary Court to try such causes pending in the Supreme Court as the Chief Justice shall from time to time direct. Every such cause is to be tried by him as Judge of the Summary Court and not as Acting Chief Justice, and there is an appeal from his Decision to the Chief Justice.
I am of opinion that under this provision it is not competent to the Chief Justice to direct the Judge of the Summary Court to try all cases pending in the...
